Appealing Your In-progress Case (Pre-judgment Relief)
While cases are in process, prior to final judgment or disposition, there may be rulings made in regard to different aspects of the case-motions, for example. If a ruling is detrimental or makes the case more challenging, I can request relief from the courts while the case is pending.
One way I request relief is through writs. By strategically utilizing writs, such as writs of mandate or of supersedeas, I can ask for a stay from the appellate court while seeking to overturn a ruling made by the trial court. This type of injunction can be especially useful when clients face bank account garnishment and levies.
Though writs are discretionary and courts are not required to consider them, my experience can often help increase the chances of being heard. Because I have represented numerous cases and clients, I have developed a thorough knowledge of the criteria and procedures trial courts appreciate and respect.
Filing Post-judgment Appeals
When filing appeals post judgment, I know how to be a strong advocate for my clients and have significant experience developing and delivering convincing appellate briefs and oral arguments. I am also experienced in mediation and other forms of alternative dispute resolution (ADR) and I know how to use these tools to a client's benefit during the appellate process.
Often writs, and occasionally appeals, are emergency measures requiring immediate response from the lawyer. I have the capacity to do an incredible amount of work in a very small amount of time; for example, I can get writs on file within days rather than weeks.
